1. Introduction
These Terms of Use ("Terms") govern your use of the MOTChecker.co.uk website and services (the "Service") operated by Sawtry Media Limited ("we", "us", "our"), a company registered in England and Wales under Company Number 05080337, with its registered office at Eco Innovation Centre, Peterscourt, City Road, Peterborough, Cambridgeshire, PE1 1SA. VAT Registration Number: GB200017196.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. The Service
MOTChecker.co.uk provides vehicle information services including MOT history checks, tax status, vehicle specifications, valuations, tyre data and MOT station searches for UK registered vehicles. Data is sourced from the Driver and Vehicle Licensing Agency (DVLA), the Driver and Vehicle Standards Agency (DVSA) and other trusted third-party providers.
3. Accounts
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information and keep it up to date.
We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent, abusive or unlawful purposes.
4. Credits and Subscriptions
4.1 Free Credits
Unregistered and free-tier users receive a limited number of daily search credits. These reset each day at midnight and do not carry over.
4.2 Subscription Plans
Paid subscription plans provide a monthly allocation of credits. Subscription credits are allocated at the start of each billing period and do not carry over to the next period. Subscriptions auto-renew unless cancelled before the next billing date.
4.3 Purchased Credits
Additional credits may be purchased individually. Purchased credits are valid for 12 months from the date of purchase.
4.4 Non-Refundable
All payments for subscriptions and credits are non-refundable. This includes, without limitation, monthly subscription fees, individual credit purchases, and any unused credits remaining at the end of a billing period or upon account cancellation. By making a purchase, you acknowledge and agree that no refunds will be issued under any circumstances, including but not limited to dissatisfaction with the data provided, cancellation of your subscription mid-period, unused credits, or account termination.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to access the Service through automated means (bots, scrapers, scripts) without our written permission
- Circumvent or attempt to circumvent rate limits, usage restrictions or security measures
- Resell, redistribute or commercially exploit data obtained from the Service without our written permission
- Use the Service to harass, stalk or intimidate any person
- Interfere with or disrupt the Service or its infrastructure
6. Data Accuracy and Disclaimer
The information provided through the Service is sourced from third-party data providers including the DVLA, DVSA and other trusted industry sources. While we endeavour to present accurate and up-to-date information, we do not guarantee, warrant or represent that any data displayed on the Service is accurate, complete, current or error-free.
Vehicle data including but not limited to MOT history, tax status, mileage readings, valuations, specifications, tyre data and emissions information may contain errors, omissions or outdated information. You must carry out your own independent checks and due diligence before making any decision based on information obtained from the Service.
The Service is provided for informational purposes only and does not constitute professional advice. It is not a substitute for a physical vehicle inspection, an independent mechanical assessment, an HPI check, or any other professional evaluation.
7. Limitation of Liability
To the fullest extent permitted by law, Sawtry Media Limited, its directors, officers, employees and agents shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages, including but not limited to:
- Financial loss arising from reliance on data provided by the Service
- Loss arising from the purchase or sale of a vehicle based on information obtained from the Service
- Loss arising from inaccurate, incomplete or outdated vehicle data
- Loss arising from inaccurate valuations
- Loss arising from service interruptions or unavailability
- Loss of data, profits, revenue or business opportunity
This limitation applies whether the claim is based in contract, tort (including negligence), strict liability or any other legal theory, even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
8. Tax and MOT Reminders
Where you opt in to receive tax or MOT expiry reminders by email or SMS, these are provided as a convenience only. We do not guarantee that reminders will be sent, delivered or received on time, and we accept no liability for any loss, fine, penalty or consequence arising from missed, delayed or undelivered reminders. It remains your sole responsibility to ensure your vehicle tax and MOT are renewed on time.
9. Intellectual Property
All content, design, logos, trademarks and software on the Service are the property of Sawtry Media Limited or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute or create derivative works without our written permission.
10. Third-Party Services
The Service may contain links to third-party websites or services (e.g. GOV.UK for tax renewal, MOT station websites). We are not responsible for the content, accuracy or practices of any third-party sites.
11. Modifications to the Service
We reserve the right to modify, suspend or discontinue any part of the Service at any time without notice. We shall not be liable to you or any third party for any modification, suspension or discontinuance of the Service.
